Terms of Service

1. Agreement

These Terms of Service (the “Terms”) are a legally binding agreement between you and Fahim Code LLC (United States) and Fahim Code LTD (Bangladesh) (together, “Fahim Code”, “we”, “us”). By accessing fahimcode.com, booking a call, paying an invoice, installing an app, creating an account, or otherwise using our services, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Delivery & Fulfillment Policy. If you do not agree, do not use our services.

If you use our services on behalf of a company, you represent that you have authority to bind that company. Custom statements of work, proposals, or order forms control if they conflict with these Terms for that project.

2. Who we are

Fahim Code LLC (United States) and Fahim Code LTD (Bangladesh) provide web development, mobile apps, Shopify and Webflow work, GoHighLevel setup, automation, APIs, funnels, and related consulting. Contact: [email protected].

We serve clients worldwide and may receive international payments.

3. Services covered

These Terms apply to:

• Our public website, booking tools, and marketing content
• Custom client work (websites, apps, integrations, retainers)
• Software, SaaS, APIs, and digital products we publish
• Facebook, Instagram, Messenger, and WhatsApp apps or Business integrations (Meta Platform)
• iOS apps distributed through the Apple App Store
• Android apps distributed through Google Play
• Web apps, Chrome extensions, and similar products

4. Accounts and eligibility

You must provide accurate information and keep credentials secure. You are responsible for activity under your account. You must be at least 13 years old (or 16 in the EEA/UK if that is the applicable digital-consent age). Apps intended for children, if any, will state that separately and follow Apple, Google, and COPPA rules.

If an app offers account creation, you can request deletion as described on our Data Deletion page. Apple and Google require in-app deletion when an app lets users create an account; we will provide that path in any such app.

5. Payments and international transfers

We may invoice in USD, EUR, GBP, BDT, or another currency stated on the invoice. We accept payment through processors and rails such as Stripe, Wise, PayPal, Payoneer, Relay, bank transfer, cards, and similar providers we enable from time to time. The checkout or invoice will name the processor used for that payment.

• You authorize us and the processor to charge the selected method for the agreed amount, taxes, and fees.
• Processor, FX, and bank fees may be deducted by the provider. You are responsible for your own bank or FX fees unless we agree otherwise in writing.
• Prices may exclude VAT, GST, sales tax, or similar. You are responsible for taxes that apply to you.
• Deposits, milestone payments, and retainers are due as stated in the invoice or statement of work.
• Late amounts may pause work. We may charge reasonable collection costs for overdue invoices.
• Chargebacks filed in bad faith after delivered work may result in suspension and recovery of the disputed amount plus processor fees.

Payment processors are independent controllers or processors of card and bank data. We do not store full card numbers. See our Privacy Policy for how payment data is handled.

The billing entity (Fahim Code LLC or Fahim Code LTD), the currency, the total, and the billing descriptor that will appear on your card statement are shown on the checkout page and invoice receipt before you pay. If a charge looks unfamiliar, email [email protected] or call +8801816430665 before filing a dispute — we will identify it, usually the same business day.

6. Refunds and cancellations

Refunds are governed by the Refund Policy. In short: unused prepaid digital products may be refundable within 14 days where required by law; custom development after work has started is generally non-refundable except for unused prepaid hours; App Store and Google Play purchases must be refunded through Apple or Google.

7. Subscriptions and in-app purchases

If we offer auto-renewing subscriptions or in-app purchases on Apple or Google:

• Price, billing period, and what is included will be shown before purchase.
• Subscriptions renew until you cancel in Apple ID, Google Play, or in-app settings, as applicable.
• Apple’s and Google’s payment terms apply to store purchases. We do not control store refunds.
• We will not bill users outside the official in-app purchase system for digital goods consumed in an iOS or Play app, unless a platform exception applies.

8. Apple App Store and Google Play

If you download our app from Apple or Google, you also agree to that store’s terms. Apple and Google are not parties to these Terms except for third-party beneficiary rights Apple requires in a custom EULA (including that Apple has no obligation to provide maintenance or support, and that claims relating to the app are between you and Fahim Code, not Apple). Licensed use on Apple devices is non-transferable and limited to devices you own or control, as allowed by the App Store terms.

Export rules may apply. You may not use the apps if you are in a sanctioned territory or on a restricted party list.

9. Meta (Facebook, Instagram, WhatsApp, Messenger)

If you use a Fahim Code product that connects to Meta platforms, you also agree to Meta’s terms, including the Facebook Terms of Service, Meta Platform Terms, Developer Policies, and any WhatsApp Business terms that apply. You grant us permission to access only the data Meta shares with the app that is needed to provide the requested feature.

• We use Meta data only to operate the app or integration you requested.
• We do not sell Meta user data. We do not use it to build unrelated advertising profiles.
• You can remove the app from your Facebook or Instagram settings and request deletion via our Data Deletion page.
• We comply with Meta’s Limited Use and data deletion requirements for Platform apps.

10. Acceptable use

You will not:

• Break the law, infringe IP, or upload malware
• Harass others, scrape without permission, or overload our systems
• Use our apps to spam, phish, or violate Meta, Apple, or Google policies
• Misrepresent payments, abuse refunds, or process transactions for prohibited businesses
• Attempt to reverse engineer except where the law allows

We may suspend access for abuse, unpaid invoices, legal risk, or platform policy violations.

11. Client materials and intellectual property

You keep IP in materials you provide. You grant us a license to use those materials to perform the work. Upon full payment for custom deliverables, you own the final agreed deliverables, except for our pre-existing tools, libraries, themes, and third-party components (which stay with their owners and are licensed to you as needed to use the work). We may show completed work in our portfolio unless your contract says otherwise.

Our website, trademarks, app code, and documentation remain ours. You may not copy them except as allowed by these Terms or a separate license.

12. Third-party services

Shopify, Webflow, Meta, Google, Apple, Stripe, Wise, hosting providers, and similar tools have their own terms. We are not responsible for outages or policy changes on those platforms. You must have valid accounts and licenses for tools you ask us to use.

13. Warranties and disclaimers

Client work is provided with reasonable professional care. Public websites, free tools, and apps are provided “as is” except where the law requires otherwise. We do not warrant uninterrupted or error-free operation, or that a project will achieve a specific revenue result unless a signed agreement says so.

14. Limitation of liability

To the fullest extent allowed by law, Fahim Code is not liable for indirect, incidental, special, consequential, lost profits, or punitive damages. Our total liability for a claim is limited to the fees you paid us for the service giving rise to the claim in the 12 months before the claim (or USD 100 if you paid nothing). Some places do not allow these limits; in those places our liability is limited to the maximum the law allows.

15. Indemnity

You will defend and indemnify Fahim Code against claims arising from your content, your misuse of the services, your violation of these Terms, or your violation of Apple, Google, Meta, or payment-provider rules, except to the extent caused by our willful misconduct.

16. Termination

Either party may stop a project as set out in the statement of work. We may terminate access to apps or the website immediately for material breach. Sections that should survive (IP, payments owed, liability, privacy) remain in effect.

17. Governing law

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence still apply. Courts in Dhaka, Bangladesh have non-exclusive jurisdiction, unless a consumer-protection law requires otherwise.

18. Changes

We may update these Terms. The “Last updated” date will change. Continued use after the update means you accept the new Terms. Material changes to paid subscriptions will be communicated as required by law or store rules.
